3D – Terms & Conditions

Licensed Content – Specific Agreement for Volvo Cars’ 3D Models

1. Licensed Content

1.1. This agreement is concluded between you and Volvo Cars and shall apply for the use of Volvo Cars’ Licensed Content (hereinafter "Licensed Content Agreement").

1.2. Licensed Content means the 3D models of certain cars manufactured by Volvo Cars and related materials provided by Volvo Cars to you on the Portal.

1.3. This Licensed Content Agreement incorporates the Terms and Conditions of the Volvo Cars’ Developer Portal. The terms of this Licensed Content Agreement supersede portions of the Volvo Cars Portal Terms and Conditions (“Terms and Conditions”).

2. License

2.1. Subject to and conditioned on your compliance with the Terms and Conditions, Volvo Cars hereby grants you a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to use, reproduce, and make modifications on and otherwise use the Licensed Content provided on the Portal for personal use only (the “Permitted Use”).

2.2. Volvo Cars exclusively owns all right, title and interest in the Licensed Content. Volvo Cars reserves all rights not expressly granted to you in this Licensed Content Agreement. Except for the limited rights and licenses expressly granted under this Licensed Content Agreement, nothing in this Licensed Content Agreement grants, by implication, waiver, estoppel, or otherwise, to you any intellectual property rights or other right, title, or interest in or to the Licensed Content.

3. License Fee

The use of the Licensed Content is offered free of charge. Volvo Cars expressly reserves the right to offer the Licensed Content for a fee at a later stage.

4. Use Restrictions

4.1. You agree to only use the Licensed Content for the Permitted Use and shall not disclose, release, distribute, or deliver the Licensed Content, or any portion thereof, to any third party or any webpage without Volvo Cars’ prior written consent , unless requested by Volvo Cars or permitted under a specific event, contest or promotion conducted by Volvo Cars. Any purpose or use not specifically authorised herein is prohibited unless otherwise agreed to in writing by Volvo Cars. You further agree not to use the Licensed Content for commercial use, or to use it to develop a competing product or service. You agree to promptly take down any derivative works of the Licensed Content if Volvo Cars provides you written notice to do so.

4.2. You shall not at any time, directly or indirectly remove any copyright or proprietary notices included within the Licensed Content or use the Licensed Content in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.
